These Terms and Conditions ("Terms") govern your access to and use of the ParentMate website, application, and AI-powered parenting support chatbot (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. What ParentMate Is — and What It Is Not
ParentMate is an AI-powered parenting support tool that provides guidance grounded in established child psychology frameworks and real-life scenarios reviewed by a licensed youth counselor.
ParentMate is NOT:
- A substitute for professional psychological, psychiatric, or medical advice, diagnosis, or treatment.
- A licensed therapist, counselor, or healthcare provider.
- An emergency or crisis service.
If your child is in immediate danger or you suspect a serious mental health concern, please contact your local emergency services or a licensed professional immediately. ParentMate will encourage you to do so when appropriate but cannot replace human professional intervention.
3. Eligibility
You must be at least 18 years of age to create an account and use ParentMate. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
ParentMate is not directed at children. We do not knowingly collect personal data from anyone under the age of 18 as a user of the Service.
4. Account Registration
4.1 Creating an Account
You may register for an account using:
- Email address and password; or
- Third-party authentication (Google or Apple sign-in).
You must provide accurate, current, and complete information during registration and keep your account details up to date.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at privacy@parentmate.com if you suspect unauthorized access.
4.3 One Person, One Account
Each account is personal to you. You may not share, transfer, or sell your account to another person.
5. Service Plans and Pricing
5.1 Available Plans
ParentMate offers the following plans:
- Free Plan — limited to 10 questions during the free trial, with access to core features.
- ParentMate Starter — conversations per month, conversation history, 1 child profile, and multi-language support. Billed monthly or annually depending on the plan selected at checkout.
- ParentMate Plus — conversations per month, up to 3 child profiles under one account and shared conversation threads. Billed monthly or annually depending on the plan selected at checkout.
- ParentMate Pro — Unlimited conversations per month, up to 20 child profiles under one account and shared conversation threads. Billed monthly or annually depending on the plan selected at checkout.
5.2 Pricing
Current pricing is displayed on our website at the time of purchase. We reserve the right to change pricing with 30 days' prior notice to existing subscribers. Price changes do not affect the current billing period.
5.3 Payments
Payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your selected payment method on a recurring basis (monthly or annually, depending on your plan) until you cancel.
6. Right of Withdrawal and Refund Policy
6.1 EU and UK Users — Right of Withdrawal
Under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013, you have the right to withdraw from a distance contract within 14 days of purchase without giving any reason.
However, by checking the required consent box at checkout, you:
(a) Expressly request that the Service begins immediately upon purchase, before the 14-day withdrawal period has expired; and
(b) Acknowledge that you lose your right of withdrawal once the digital service has been fully performed, or — for ongoing subscriptions — once the Service has commenced delivery within the withdrawal period.
If the Service has not yet been accessed or used at all within the 14-day withdrawal period, you may still request a withdrawal by contacting us at privacy@parentmate.com.
6.2 General Refund Policy
Outside of the statutory withdrawal right described above, all payments are final and non-refundable. This includes:
- Partial billing periods after cancellation.
- Downgrading from a paid plan to the Free plan.
- Unused conversations or features.
6.3 Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation:
- You retain access to your paid plan until the end of the current billing period.
- Your account will revert to the Free plan at the end of that period.
- Conversation history may become inaccessible under the Free plan but is not deleted until you request deletion or close your account.
7. Acceptable Use
You agree to use ParentMate for its intended purpose — personal parenting support. You must NOT:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract the underlying AI model, algorithms, or training data.
- Use the Service to generate content that is harmful, abusive, threatening, or discriminatory.
- Misrepresent ParentMate's advice as professional psychological or medical counsel.
- Use automated systems (bots, scrapers) to access the Service without our written permission.
- Resell, sublicense, or commercially redistribute any ParentMate output.
- Submit content that infringes third-party intellectual property or privacy rights.
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.
8. Intellectual Property
8.1 Our Property
All content, design, branding, underlying technology, AI models, and response frameworks of ParentMate are the intellectual property of Ewa Jarzemska or her licensors. Nothing in these Terms transfers ownership of any intellectual property to you.
8.2 Your Content
You retain ownership of the text and information you submit to ParentMate ("Your Content"). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use Your Content for the following purposes:
- Providing the Service — processing your inputs to generate personalized responses.
- Improving the Service — using anonymized and aggregated conversation data to improve ParentMate's AI model, response quality, and features. See our Privacy Policy for details on how this data is handled.
You may revoke this license by deleting your account, after which we will delete your personal data in accordance with our Privacy Policy. Anonymized, aggregated data that can no longer be linked to you may be retained.
9. AI-Generated Content Disclaimer
9.1 Nature of Responses
ParentMate's responses are generated by an artificial intelligence model. While the model is grounded in established child psychology frameworks and counselor-reviewed scenarios, responses are:
- Probabilistic, not deterministic — the model generates the most likely helpful response, but it is not infallible.
- General guidance, not personalized professional advice — responses are tailored to the context you provide but do not account for your child's full medical, psychological, or developmental history.
- Not guaranteed to be accurate, complete, or up to date in all circumstances.
9.2 Your Responsibility
You acknowledge that you are the decision-maker regarding your child's wellbeing. ParentMate provides guidance and perspective; it does not make decisions for you. Always exercise your own judgment and consult a qualified professional for serious concerns.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Ewa Jarzemska shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- Our total aggregate liability for any claims relating to the Service shall not exceed the total amount you paid to ParentMate in the 12 months preceding the claim.
- We are not liable for any decisions you make, or actions you take, based on information provided by the Service.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be excluded or limited under applicable law.
11. Availability and Modifications
11.1 Service Availability
We aim to keep ParentMate available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
11.2 Changes to the Service
We may modify, update, or discontinue features of the Service at any time. Material changes that negatively affect your paid subscription will be communicated with 30 days' prior notice.
11.3 Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Termination
12.1 By You
You may close your account at any time by contacting us at privacy@parentmate.com or through your account settings. Upon closure, your data will be handled in accordance with our Privacy Policy.
12.2 By Us
We may suspend or terminate your account if:
- You breach these Terms.
- Your use of the Service poses a risk to other users, to us, or to third parties.
- We are required to do so by law.
Where possible, we will provide notice before termination and an opportunity to export your data.
13. Governing Law and Disputes
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.
13.2 Jurisdiction
Any disputes arising from or in connection with these Terms shall be submitted to the competent courts of Warsaw, Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.
13.3 EU Users — Online Dispute Resolution
If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to attempt to resolve disputes.
13.4 UK Users
If you are a consumer in the United Kingdom, nothing in these Terms affects your statutory rights under UK consumer protection law.
14. Miscellaneous
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ParentMate regarding the Service.
- No Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment. We may assign our rights and obligations under these Terms. You may not assign yours without our prior written consent.
